Charges: This report should address the charges below.
1. Implementation of Federal Regulations: Study the impact and identify challenges Texas faces implementing proposed federal Environmental Protection Agency regulations, including, but not limited to the Clean Power Plan, Reduction of Methane & Volatile Organic Compounds (VOCs) from oil and gas facilities, Ozone standards, Regional Haze, and Waters of the U.S. Make recommendations for legislative or constitutional action the committee considers necessary.
2. Texas Emission Reduction Plan (TERP): Study and make recommendations regarding the use of Texas Emission Reduction Plan (TERP) funds, including reducing air emissions from mobile sources in response to changes in ozone standards.
3. Economic Development: Evaluate the effectiveness and necessity of programs and resources currently used to support economic development in Texas. Make recommendations regarding continuation of effective strategies, modification of existing administrative or regulatory barriers, and the reduction or elimination of ineffective programs.
4. Expedited Permitting: Evaluate the permitting process in Texas and neighboring states and make recommendations for eliminating unnecessary barriers and expediting the process to ensure that the regulatory process is consistent and predictable.
5. ERCOT/PUC Electricity Issues: Conduct legislative oversight and monitoring of agencies and programs under the committee's jurisdiction. In this oversight and monitoring, the committee should: 1) identify and recommend opportunities to streamline programs or services and enhance grid safety while maintaining the mission of ERCOT and PUC and their programs; and 2) identify barriers ERCOT or PUC may have in their governance that may be appropriate to improve or eliminate.
6. Oil Field Theft: Study and make recommendations for solving the oil field theft problems facing Texas, including identifying the proper mechanisms for increasing enforcement effectiveness.
7. Monitoring Charge: Monitor the implementation of legislation addressed by the Senate Committee on Natural Resources and Economic Development during the 84th R.S. and make recommendations for any legislation needed to improve, enhance, and/or complete implementation. Specifically, monitor the following: 1)Legislation relating to Texas aerospace incentives; 2) Expedited permitting; and 3) Electric utility rate adjustments.

1. Study public school management practices, including the use and options for shared services for both academics and operations. Examine the role of Regional Education Service Centers. Specifically, review the types of services being provided and their ability to assist school districts with improving efficiencies.
2. Study educator and principal preparation programs through colleges of education and alternative certification. Make recommendations to improve these programs. Examine strategies to improve recruitment of high-quality teachers. Examine alternative approaches to improving teacher retention. Study the benefits of comprehensive induction and mentoring programs.
3. Study the growing demand for virtual schools in Texas. Review the benefits of virtual schools, related successes in other states, and needed changes to remove barriers to virtual schools.
4. Study the impact of extended learning time on school success. Evaluate the different programs offered, best practices, school implementation, and incentives for building community partnerships that allow a variety of academic and career-related learning opportunities. Examine the effect of after-school programs on academic performance, school attendance, behavior, and promotion to the next grade level, and the relationship between the availability of after-school programs in an area and the high school dropout rate.
5. Study the performance and accountability of charter schools, best practices of high-performing charter schools, and barriers to replication. Review policies and practices for authorizing high-quality charters and closing poor-performing charters. Study the benefits of and costs related to increasing the number of charters, as well as establishing additional authorization boards to grant new charters
6. Study the impact of school choice programs in other states on students, parents, and teachers. Explore the use of education tax credits and taxpayer savings grants, and examine potential impacts on state funding.
7. Conduct a comprehensive review of school discipline practices. Specifically, review and make recommendations on:
  • The effectiveness of Disciplinary Alternative Education Programs (DAEP) and Juvenile Justice Alternative Education Programs (JJAEP) in reducing student involvement in further disciplinary infractions and in promoting positive educational achievement;
  • Disproportionate school discipline referrals, including suspension, expulsion, and Class C misdemeanor citations;
  • The issue of "Zero Tolerance" in secondary education school discipline, the use of alternative education campuses, and the barriers to graduation. Also include the role that specialized school police departments play in these systems. Consider the impact on the juvenile justice system and the adult prison system;
  • The number of students in the conservatorship of the Department of Family and Protective Services (DFPS) referred to juvenile or municipal courts, suspended, expelled, and placed in Disciplinary Alternative Education Programs (DAEP). Examine data-sharing practices between DFPS, TEA, and local education agencies, and make recommendations to increase communication between schools and DFPS to increase educational outcomes for children in foster care;
  • Evidence based models used for addressing juvenile delinquency prevention that is targeted to non-adjudicated, but at-risk youth, in the school disciplinary system. (Joint Charge with Senate Committee on Criminal Justice)
8. Monitor the implementation of legislation addressed by the Senate Committee on Education, 82nd Legislature, Regular and Called Sessions, and make recommendations for any legislation needed to improve, enhance, and/or complete implementation. Specifically, monitor the following:
  • SB 6, 82nd R.S., relating to the establishment of the instructional materials allotment;
  • SB 8, 82nd R.S., relating to the flexibility of the board of trustees of a school district in the management and operation of public schools;
  • HB 1942, 82nd R.S., relating to bullying in public schools;
  • The implementation of legislation related to the state's accountability system and other reforms enacted by HB 3, 81st R.S., and SB 1031, 80th R.S..

1. Study the effectiveness of cash management strategies of the state. Review the quarterly amount of cash on hand and its use and potential to generate excess returns. Include an assessment of cash flow problems that exist in school districts and request that the Comptroller of Public Accounts report on the additional short-term borrowing needed and the potential impact on bond ratings if legislation is not passed which allows for the "smoothing" of state payments to school districts.
2. Explore the policy implications of allowing school districts, or other public agencies, to participate in a permissive pooled collateral program which provides for the centralization of collateral in a pool which will be tracked and verified to meet state requirements.
3. Compile a list of significant state assets and infrastructure, including but not limited to the state lottery and state real property, and determine if each asset is being used to the highest and best use possible in the interest of taxpayers of Texas. Where appropriate, provide analysis of alternative uses of underperforming assets, potential cost savings or revenue gains and the legislative actions that would be needed to make the changes that are in the best interest of taxpayers.
4. Study the funding of county public hospitals and the role neighboring counties without a county hospital should play.
5. Review and evaluate appropriate state regulation of a private operator of the state lottery should the state receive bids for a lease of the lottery that merit strong consideration. Provide recommendations for ensuring the security and integrity of the lottery and for adequate consumer protections. (Joint charge with Senate State Affairs Committee)
6. Review and make recommendations that address the state's facility infrastructure needs for public schools, ensuring that funding remains stable, reliable and equitable. Examine the need for funding adjustments for factors that affect the need for facilities, such as fast growth, age and condition of facilities, adequacy of space, construction and land costs, and concentration of students requiring smaller class sizes. Assess the impact on property taxpayers of “rolling forward” the Existing Debt Allotment (EDA) each session and the change in biennial appropriations for the Instructional Facilities Allotment (IFA). 6. Study the appropriate role of and relationships between the levels of education in Texas. Such relationships include elementary/secondary education and higher education, and two year and four-year institutions.

1. Oversight responsibility of agency expenditures and related transactions. This function shall encompass a review and monitoring of all appropriations-related actions of those agencies assigned to this committee for appropriative purposes during the 65th Regular Session of the Legislature, to wit: State Board of Education (Central Education Agency) (Schools for the Blind and Deaf)
2. A study of the possibilities of an "early graduation" program from public schools. This study should include recommendations as to the means by which such a program could be initiated and enacted as well as a review of alternatives to twelve full years of public education, such as vocational and technical programs and training in lieu of traditional courses.
3. A review the impact of the federal regulations and judicial interpretations of Section 504 of the Rehabilitation Act of 1973 as that act pertains to education and its various component parts in the public sector in Texas. This study should assess the fiscal and policy ramifications of this legislation and make recommendations as to necessary implementing legislation therefor.
4. A study of the administration of large school districts. This study should include a review of the advisability of and methodology of reorganization of large school districts; recommendations on how best to deal legislatively with problems associated with these districts, such as teacher morale, increased violence, access to supervisory personnel, discipline problems, accountability to taxpayers and parents, and increasingly lower test and achievement scores.
5. A study of the effects and ramifications of a "quarter system" on the curriculum and effectiveness of public schools.
