Charges:	This report should address the charges below.
1.	Review the existing and anticipated populations in state prisons and city and county jails located near the Texas-Mexico border. Make recommendations for alleviating or addressing any increase or over-crowding that may result as well as any other particularized needs or circumstances that have arisen or could arise as a result of an increase in population in correctional facilities, including, but not limited to, intake capacity, adequacy of facilities and other health and safety considerations. Make recommendations to mitigate any associated costs borne by border counties and municipalities. (Joint charge with Committee on Corrections)
2.	Monitor the agencies and programs under the Committee’s jurisdiction and oversee the implementation of relevant legislation passed by the 87th Legislature. Conduct active oversight of all associated rulemaking and other governmental actions taken to ensure the intended legislative outcome of all legislation, including the following: HB 1545, 87th R.S., relating to the continuation and functions of the Commission on Jail Standards; HB 1906, 87th R.S., relating to grants awarded to reimburse counties for the cost of monitoring defendants and victims in cases involving family violence; and HB 2073, 87th R.S., relating to quarantine leave for fire fighters, peace officers, detention officers, and emergency medical technicians employed by, appointed by, or elected for a political subdivision.
3.	Study statutorily mandated services provided by sheriffs and constables and determine whether fee schedules are set at sufficient levels to allow for cost recovery without placing undue burdens on recipients of those services.
4.	For individuals in county jails and Texas Department of Criminal Justice facilities, or on community supervision or parole, examine: The availability of behavioral health services; and The current treatment and recovery options available for those who are experiencing withdrawal from drug or alcohol use. Make recommendations for best practices to address the needs of individuals requiring treatment. (Joint charge with Committee on Corrections)

1.	Annexation: Identify areas of concern in regards to statutory extraterritorial jurisdiction expansion and the processes used by municipalities for annexation, specifically reviewing whether existing statute strikes the appropriate balance between safeguarding private property rights and encouraging orderly growth and economic development. Make recommendations for legislative action, if necessary.
2.	Local Ordinance Integrity: Examine the processes used by home rule municipalities to adopt ordinances, rules, and regulations, including those initiated by petition and voter referendum. Determine if additional statutory safeguards are necessary to ensure that ballot language accurately describes proposed initiatives. Identify ways to improve transparency and make recommendations, if needed, to ensure that local propositions and the means by which they are put forth to voters, conform with existing state law.
3.	Disaster Preparedness Planning and Coordination: Review natural disaster preparedness planning and coordination in the wake of a growing range of threats. Evaluate whether existing processes maximize regional cooperation to rebuild housing and infrastructure, and allow for the timely dissemination of funds to units of local governments for reconstruction following a federal declaration. Develop recommendations, if necessary, to improve the efficiency of disaster recovery efforts, incorporating best practices identified from other states, as well as lessons-learned from past reconstruction efforts in Texas.
4.	Municipal Management Districts: Study the means by which the Texas Legislature reviews the creation of municipal management districts (MMDs) by special law to determine if different processes should be used to evaluate new MMDs created within populated or developed areas from those created over undeveloped areas. Identify ways to better assess how the services and improvements of a proposed Page 5 of 5 MMD within populated or developed areas will supplement and enhance those provided by other local governments, as well as if the territory of the proposed MMD encompasses or overlaps area that is already within other assessment or taxing entities. Make recommendations, if necessary, to improve the notice provided to individuals and businesses within populated or developed areas proposed for inclusion in an MMD.
5.	Supreme Court ICP Ruling: Review existing statute and rules that govern the Texas Department of Housing and Community Affairs in light of the recent Supreme Court decision in Inclusive Communities Project, Inc. vs. TDHCA, et al. and recommend if any modifications are necessary to conform to the decision.
6.	Debt Transparency in the Voting Booth: Examine ways to improve government accountability in elections regarding the issuance of public debt. Include a review of the information that is currently provided to individuals in the voting booth and provide statutory recommendations, if necessary, to improve transparency.

Study the effectiveness and efficiency of current programs in Texas as well as best practices to determine how to decrease the risk and mitigate the impact of wildfires, floods, and other natural hazards in the wildland-urban interface. Examine the duties, performance, and jurisdictions of water districts, municipalities, Emergency Services Districts, other similar districts, and state offices like the Fire Marshal and Extension Services. Evaluate current regulations and identify best practices. Recommend approaches for hazard mitigation and response to natural disasters. (Joint charge with the House Committee on County Affairs)
2.	Identify and address potential gaps in cities’ cybersecurity policy and ensure that personal information held by cities and other municipal entities is secure.
3.	Examine whether changes are needed to the Texas Department of Housing and Community Affairs’s (TDHCA) low-income tax credit program to ensure compliance with the U.S. Supreme Court's decision in Texas Department of Housing and Community Affairs et al. v. Inclusive Communities Project, Inc., et al. on fair housing in Texas.
4.	Review existing housing programs and policies in Texas to determine how to best comply with the U.S. Department of Housing and Urban Development's new Affirmatively Furthering Fair Housing Rules.
5.	Monitor and evaluate the availability of low-income housing in the State of Texas. Identify best practices to ensure that the agencies and local providers receiving state or federal funds for low-income housing are maximizing the number of units of housing available to Texans who need this program.
6.	Investigate the operation and regulation, including a review of standards, monitoring, and enforcement, of boarding homes in municipalities and unincorporated areas of counties. Identify communities that have adopted local standards, and review procedures for investigating and closing unlicensed facilities that are providing services which require state licensure. (Joint charge with the House Committee on Human Services)
7.	Conduct legislative oversight and monitoring of the agencies, including the Texas Department of Housing and Community Affairs, and programs under the committee's jurisdiction and the implementing of relevant legislation passed by the 84th Legislature. In conducting this oversight, the committee should: a. consider any reforms to state agencies to make them more responsive to Texas taxpayers and citizens; b. identify issues regarding the agency or its governance that may be appropriate to investigate, improve, remedy, or eliminate; c. determine whether an agency is operating in a transparent and efficient manner; and d. identify opportunities to streamline programs and services while maintaining the mission of the agency and its programs.

7.	Examine county authority to utilize tax increment financing and transportation reinvestment zones to fund transportation projects.
8.	Monitor and review the efforts of the Department of Transportation’s (TxDOT) Texas Technology Task Force (TTTF). The TTTF shall study emerging transportation, communication, and computing technologies and determine physical infrastructure and system components that TxDOT or other state departments would need to provide to enable selected technologies. The task is to be completed by TTTF as directed by SB 1, 83rd R.S., item 44, Article VII-31. (Joint charge with the House Committee on Technology)

Study the policies and actions the State can pursue to preserve state authority and protect Texas citizens from federal overreach in the form of conditional federal grants, conditional federal preemption, and excessive legislation and regulation interfering with states' enumerated powers by Congress.
2.	Examine the Texas Workers' Compensation system and make recommendations for changes to meet the needs of Texas employers and employees. Specifically, review the following: the dispute resolution process and benefits available from employers that do not subscribe to workers compensation; the adequacy of income benefits in the workers’ compensation system, specifically on high?wage earners receiving the maximum compensation rate; identify and report on fatalities in the Workers’ Compensation System, including the amount of death and burial benefits paid to beneficiaries and the Subsequent Injury Fund since 2000; the return-­to-­work numbers and results for injured employees in the Workers’ Compensation System that are referred to the Department of Assistive and Rehabilitative Services.
3.	Study the feasibility and fiscal impact to consumers of altering the insurance code to allow for the purchase of health insurance across state lines.
4.	Monitor the potential impact of the Patient Protection and Affordable Care Act (PPACA) on insurance regulations, Medicaid and CHIP, health care outcomes and overall health of all Texans, and the state budget in Texas. Additionally, monitor the current constitutional challenges to PPACA and other court cases associated with PPACA, and ensure that the state does not expend any resources until judicial direction is clear. (Joint charge with Senate Health & Human Services Committee)
5.	Study and make recommendations on statutory provisions and judicial decisions relating to the statute of limitations on a cause of action relating to consumer debt.
6.	Examine establishing a workforce retention program or deferred retirement option plan (DROP) for Texas Department of Public Safety commissioned peace officers and whether any plan can be built with actuarially sustainable factors while meeting the needs of officers.
7.	Examine the feasibility of implementing Health Reimbursement Accounts and Medicare exchanges for Medicare eligible participants currently covered by and receiving health coverage through the Employees Retirement System, the Teachers Retirement System, the University of Texas, and Texas A&M University. Identify any cost savings to the state and to retirees that would occur under such a plan.
8.	Consider the costs and benefits of the creation of liability protection for private companies and individuals when commissioned by the Texas Forest Service to assist in fighting a fire that is not on the company's or individual's own land. Examine whether state policy should prohibit an employer from terminating an employee who is a volunteer firefighter on the grounds that the employee missed work because the employee was responding to an emergency. Identify any appropriate limitations that should apply to such a policy.
9.	Examine the effectiveness of the Private Real Property Rights Preservation Act (Chapter 2007, Government Code), and whether it should apply to municipalities.
10.	Monitor the implementation of legislation addressed by the Senate Committee on State Affairs, 82nd Legislature, Regular and Called Sessions, and make recommendations for any legislation needed to improve, enhance, and/or complete implementation. Specifically, monitor the following: implementation of SB 100, relating to the implementation of the MOVE Act, and the impact on local and statewide elections and military voters; implementation of the Interstate Health Care Compact.

1.	Evaluate the potential benefits offered through the "design-build" form of bidding, which allows engineers, architects, and builders to form teams and bid on state projects in contrast to the current method which mandates that each entity bid separately. The Committee shall compare the State of Texas practices to other states and to the private sector and evaluate the "design-build" option as it relates to buildings, roads, and other publicly funded projects.
2.	Study the funding and expenditures of Councils of Government (COGs) and examine the changing relationship between COGs and the state and federal governments since 1982. The Committee shall monitor the compliance by COGS regarding publication of financial statements, as referenced in the General Appropriations Bill, HB 1, 76th R.S..
3.	Review the statutory authority granted to local governments to regulate the development of residential subdivisions. The Committee shall identify conflicting provisions and make recommendations to clarify existing statutes.
4.	Monitor the implementation of SB 89, 76th R.S. relating to municipal annexation.
5.	Examine the powers, functions and programs administered by the Texas Department of Housing and Community Affairs (TDHCA) and the Texas State Affordable Housing Corporation (TSAHC). The committee's report will assess the methodology used in allocating the various housing funds and resources, including the Low-Income Housing Tax Credit program and the Housing Trust Fund, and the compliance by the agency with that methodology, and address whether the programs administered by TDHCA and the TSAHC meet the affordable housing demands of targeted population groups throughout the State of Texas.

1.	RESOLVED, By the Senate of the State of Texas, the House of Representatives concurring, that a commission to study the feasibility and advisability of consolidating of services of city and county governments to be known as the Texas Commission on City and County Governments, shall be appointed, consisting of nine (9) members; three (3) members of the Texas House of Representatives to be chosen by the Speaker of the House; three (3) members of the Senate of Texas to be chosen by the Lieutenant Governor; and three (3) public members to be appointed by the Governor of Texas. RESOLVED, That the Commission shall gather all pertinent information and data relating to consolidation of city and county governments in other states; identify and consider the factors bearing upon such consolidation of services in Texas, especially in the metropolitan areas; and study and devise ways and means both constitutionally and statutorily, of effecting consolidation of services of cities and counties in Texas.
