HB 719, 65th R.S.
To provide a new chapter to be entitled Limited Guardianship Proceedings authorizing limited guardianship proceedings for mentally retarded persons; and setting forth procedures therefor, including responsibility for reports, oath, bond and other responsibilities of the Court and the limited guardian, as well as the responsibility of the Texas Department of Mental Health and Mental Retardation for examinations of the person alleged to be mentally retarded; providing a schedule of fees for court costs; allowing waiver of such in certain cases; providing for findings, orders of the court and qualifications of the limited guardian; stating that the orders appointing limited guardians shall be said limited guardians' authority to act within the limited powers granted by such; providing that said proceedings shall not be presumed to have included a finding of incompetency; setting forth venue and transfer of venue; providing for severability and declaring an emergency.
