HBA-RBT H.B. 1010 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1010 By: Hamric Criminal Jurisprudence 3/25/1999 Introduced BACKGROUND AND PURPOSE Currently, trespassing is a Class B misdemeanor. H.B. 1010 makes trespassing a Class A misdemeanor if a person commits a trespass with the intent to arouse or gratify the sexual desire of any person. The bill also requires the person to register as a sex offender under the sex offender registration statutes. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 30.05(d), Penal Code, to include a trespass committed with the intent to arouse or gratify the sexual desire of any person in the kinds of criminal trespasses which are a Class A misdemeanor, rather than a Class B misdemeanor. Makes conforming and nonsubstantive changes. SECTION 2. Amends Article 62.01(5), Code of Criminal Procedure, as added by Chapter 668, Acts of the 75th Legislature, Regular Session, 1997, to include a trespass committed with the intent to arouse or gratify the sexual desire of any person in the list of offenses which must be reported under the sex offender registration program. SECTION 3. Makes application of this Act prospective. SECTION 4. Effective date: September 1, 1999. SECTION 5. Emergency clause.
