HBA-KMH C.S.H.B. 1020 76(R)BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 1020 By: Hupp Public Safety 4/16/1999 Committee Report (Substituted) BACKGROUND AND PURPOSE Currently, a person must be 21 years of age or older to obtain a license to carry a concealed handgun. C.S.H.B. 1020 lowers the age to 18 for active military personnel and reservists to obtain a license to carry a concealed handgun. This bill further provides that if a person is a member of the armed forces as described in this section the person may satisfy a condition for eligibility to carry a concealed handgun by being qualified to possess a handgun. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 411.172(a), Government Code, to provide eligibility for a person to obtain a license to carry a concealed handgun who is a member of the armed forces of the United States, including the reserves or national guard as defined by Section 431.001 (State Militia), Government Code, and who is 18 years of age. Provides that if a person is a member of the armed forces as described in this section the person provides that if a person is a member of the armed forces as described in this section the person may satisfy a condition for eligibility to carry a concealed handgun by being qualified to possess a handgun. SECTION 2. Provides that the text of Section 411.172(a), Government Code, as set out in this Act, gives effect to changes made by Chapter 1261, Acts of the 75th Legislature, Regular Session, 1997. Provides that this Act, to the extent of any conflict, prevails over another Act of the 76th Legislature, Regular Session, 1999, relating to nonsubstantive additions and corrections in enacted codes. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 1020 modifies the original in SECTION 1 by deleting the proposed eligibility to obtain a license to carry a concealed handgun for a person in the state militia who is less than 21 year of age and at least 18 years of age. The substitute also modifies the original in Subsection (a) by providing that if a person is a member of the armed forces as described in this section the person provides that if a person is a member of the armed forces as described in this section the person may satisfy a condition for eligibility to carry a concealed handgun by being qualified to possess a handgun.
