HBA-NMO H.B. 1021 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1021 By: Hupp Public Safety 4/12/1999 Introduced BACKGROUND AND PURPOSE Current law requires the Department of Public Safety (DPS), if it issues a license to carry a concealed handgun or a license holder makes a change of name or address, to notify the sheriff of the county in which a license holder resides. The law further requires the DPS, upon request of a local law enforcement agency in a license holder's county, to notify the agency of the same information. H.B. 1021 deletes the provision requiring sheriff notification. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 411.178, Government Code, to delete language that requires the Department of Public Safety, if it issues a license to carry a concealed handgun, to notify the sheriff of the county in which the license holder resides that a specific license has been issued. SECTION 2. Amends Section 411.181(f), Government Code, to delete language that requires the Department of Public Safety to notify the sheriff of the county in which a license holder resides of a change made under Subsection (a). Subsection (a) pertains to notice of change of address or name. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
