BACKGROUND AND PURPOSE 

The 75th Legislature prohibited commercial vehicles from parking overnight
in residential neighborhoods.   An oversight allowed the trailers of these
commercial vehicles to be detached and parked.  H.B. 1024 includes trailers
and semitrailers in the overnight parking restrictions.  

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 545.307(a)(1), Transportation Code, to add a
road tractor, truck tractor, pole trailer, or semitrailer as defined in
Section 541.201 (Vehicles), Transportation Code, to the definition of
commercial motor vehicles which may not park between 10 p.m. and 6 a.m. on
residential streets that have been properly posted under the provisions of
this section.  Makes conforming and nonsubstantive changes. 

SECTION 2.  Makes the change in the definition of commercial motor vehicles
applicable to subdivisions that were properly posted under the provisions
of this section before the effective date of this Act, without any further
requirement for petition. 

SECTION 3.  Effective date: September 1, 1999.

SECTION 4.  Emergency clause.
