HBA-RAR H.B. 1054 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1054 By: Brown, Fred Criminal Jurisprudence 4/15/1999 Introduced BACKGROUND AND PURPOSE Current law provides that a speeding offense is eligible for dismissal upon completion of a driving safety course if the offense is speeding at less than 25 miles per hour or more over the posted speed limit. In light of the recent increase of speed limits in this state, stricter penalties regarding speeding may be needed to deter drivers from traveling at high speeds. H.B. 1054 provides that a speeding offense is eligible for dismissal upon completion of a driving safety course if the offense is speeding at less than 12, rather than 25, miles per hour or more over the posted speed limit. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 543.103(b), Transportation Code, to provide that a speeding offense is eligible for dismissal upon completion of a driving safety course if the offense charged is speeding at 12, rather than 25, miles per hour or more over the posted speed limit. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
