HBA-TYH, DMD H.B. 1078 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 1078 By: Solis, Jim Urban Affairs 7/8/1999 Enrolled BACKGROUND AND PURPOSE Prior to the 76th Legislature, fire fighters and police officers (officers) who have been suspended and have had the suspension time period reduced by the Fire Fighters' and Police Officers' Civil Service Commission (commission) were entitled to full compensation for time lost. However, the law did not specifically entitle the officer to restoration of, or credit for benefits such as sick leave, vacation time, and service credit in retirement systems. H.B. 1078 entitles an officer whose suspension has been reduced by the commission to the restoration of, or credit for benefits such as sick leave, vacation time, and service credit in retirement systems. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 143.053(f), Local Government Code, to entitle a suspended fire fighter or police officer, upon reduction of the period of suspension by the Fire Fighters' and Police Officers' Civil Service Commission, to restoration of, or credit for any other benefits lost as a result of the suspension, including sick leave, vacation leave, and service credit in a retirement system. Requires standard payroll deductions, if any, for retirement and other benefits restored, to be made from the compensation paid, and requires the municipality to make its standard corresponding contributions, if any, to the retirement system or other applicable benefits systems. SECTION 2.Effective date: September 1, 1999. SECTION 3.Makes application of this Act prospective, as it applies to an appeal of a disciplinary suspension. SECTION 4.Emergency clause.
