HBA-MPM H.B. 1131 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1131 By: Hinojosa Higher Education 3/4/1999 Introduced BACKGROUND AND PURPOSE H.B. 1131 requires the University of Texas System board of regents to impose an additional onedollar admission charge to all sporting events held on the campus of, or on other property under the control of one of the system's institutions of higher education in order to fund the women's athletic department. Furthermore, this bill provides that additional monies incurred from this charge are to be distributed among the institutions in proportion to the number of women competing in intercollegiate athletics at each institution and used for specific purposes related to women's athletics. This bill also prohibits an institution from reducing the amount of other money spent to support women's athletics as a result of the receipt of money collected from the fee. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority is expressly delegated to the board of regents of the University of Texas System in SECTION 1 (Section 65.47) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter C, Chapter 65, Education Code, by adding Section 65.47, as follows: Sec. 65.47. SUPPORT OF WOMEN'S ATHLETICS. (a) Requires the board of regents (board) of the University of Texas System (system) to impose a $1 fee to the admission charge for any intercollegiate athletic event held on the campus of, or on other property under the control of, any component institution of higher education of the system. Requires the board to adopt rules relating to the collection and administration of this fee. (b) Provides that the money collected from the fee be used by the system to support women's athletics at component institutions of the system. (c) Requires the board to distribute the money collected among the component institutions in proportion to the number of women competing in intercollegiate athletics at each institution. (d) Provides that the money distributed to an institution may be used for scholarships, equipment, facilities, travel, lodging, or training for women's intercollegiate athletics at the institution. (e) Prohibits an institution from reducing the amount of other money spent to support women's intercollegiate athletics as a result of the receipt of money collected from the fee. SECTION 2. Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 3: Emergency clause.
