HBA-PDH H.B. 1156 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1156 By: Allen County Affairs 2/25/1999 Introduced BACKGROUND AND PURPOSE Currently, an unlicensed or unregistered vehicle cannot be legally operated on public streets, but the vehicle can be parked on public streets and private property. This can cause traffic congestion, and hazards, and can adversely effect the quality of life in neighborhoods. H.B. 1156 strengthens the statute by providing that a vehicle is considered a junked vehicle if the vehicle is unregistered or unlicensed; wrecked, dismantled, partially dismantled, or discarded; or is inoperable and has remained inoperable for at least 45 consecutive days. This bill prevents an operable vehicle that is unlicensed or unregistered from being parked on a public street or private property for more than 45 days. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 683.071, Transportation Code, as follows: Sec. 683.071. DEFINITION. Includes a vehicle that is self-propelled, and inoperable, and that has remained inoperable for more than 45 days within the existing definition of "junked vehicle." SECTION 2.Effective date: September 1, 1999. SECTION 3.Emergency clause.
