HBA-DMD H.B. 1165 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1165 By: Hupp Public Safety 4/14/1999 Introduced BACKGROUND AND PURPOSE Under current law, any person may obtain information from the Department of Public Safety (department) pertaining to another person's status as a holder of a concealed handgun license. H.B. 1165 deletes the department's requirement to disclose to an individual whether another named individual or any individual has a concealed handgun license. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 411.192, Government Code, to delete the requirement that the Department of Public Safety disclose to any other individual, on written request and payment of a reasonable fee to cover costs of copying, whether a named individual or any individual whose full name is listed on a specified written list is licensed under this subchapter. Creates Subsections (a)(c) from existing text. Makes conforming and nonsubstantive changes. SECTION 2.Emergency clause. Effective date: upon passage.
