HBA-MPM H.B. 1178 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1178 By: Longoria Public Education 3/25/1999 Introduced BACKGROUND AND PURPOSE Current law allows students who have been expelled from one school district to enroll in another. H.B. 1178 requires a district to continue the expulsion of a student who has previously been expelled from another district. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 37.010(g), Education Code, to require, rather than authorize, a school district (district) to continue the expulsion of a student who has previously been expelled from another school district. Deletes text authorizing the district to place the student in an alternative education program for the period specified by the expulsion order, or to allow the student to attend regular classes without completing the period of expulsion. SECTION 2. Makes this Act prospective to the 1999-2000 school year. SECTION 3. Emergency clause. Effective date: upon passage.
