HBA-MPA H.B. 1189 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1189 By: Gallego Urban Affairs 2/18/1999 Introduced BACKGROUND AND PURPOSE Currently, the law requires that in order to establish a civic center authority a petition must be filed with the county judge containing the signatures of a majority of the members of the governing bodies of at least two municipalities in the county. There are counties in Texas which only have a single incorporated municipality. H.B. 1189 modifies this requirement to permit such a petition to include the signatures of the majority of members of the governing body of only one municipality, if the civic center authority is located in a county with a population under 15,000. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 281.013(c), Local Government Code, to provide that in order to create a civic center authority a petition must be filed which includes the signatures of a majority of the members of the municipal governing body in each of two or more municipalities, if the population of the county in which the proposed authority is located is more than 15,000, or in one municipality if the county population is less than 15,000. SECTION 2. Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 3. Emergency clause.
