BACKGROUND AND PURPOSE 

Section 43.25, Penal Code, sets forth the law against a sexual performance
by a child.  This law does not include a lewd exhibition of the anus or any
portion of the female breast below the top of the areola in the definition
of sexual conduct.  H.B. 1203 adds a lewd exhibition of these portions of
the anatomy to that definition. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 43.25(a)(2), Penal Code, to include in the
definition of "sexual conduct" under Section 43.25, Penal Code (Sexual
Performance by a Child), a lewd exhibition of the anus, or any portion of
the female breast below the top of the areola. 

SECTION 2.  Makes application of this Act prospective.

SECTION 3.  Effective date: September 1, 1999.

SECTION 4.  Emergency clause.
