HBA-GUM, KMH H.B. 1274 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 1274 By: Tillery Judicial Affairs 6/21/1999 Enrolled BACKGROUND AND PURPOSE Prior to the 76th Texas Legislature, judges of municipal courts and their clerks were not authorized to administer oaths or give certificates of fact, although other persons in similar positions were so authorized. H.B. 1274 authorizes a judge or a clerk of a municipal court to administer an oath or to give a certificate of fact in a matter pertaining to a duty of the court. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 602.002, Government Code, to authorize a judge or a clerk of a municipal court to administer an oath or to give a certificate of fact in a matter pertaining to a duty of the court. Redesignates Subsections (1)-(10) to Subsections (2)-(11), respectively. SECTION 2. Emergency clause. Effective date: upon passage.
