HBA-NMO H.B. 1381 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1381 By: Isett Public Health 2/24/1999 Introduced BACKGROUND AND PURPOSE The 75th Texas Legislature enacted legislation establishing a childhood immunization registry through the Texas Department of Health. While the law requires that a parent, managing conservator, or guardian of an individual must give written consent before an individual is included in the registry, individuals have been included in the registry without consent. H.B. 1381 repeals the provisions in the Health and Safety Code responsible for the establishment and maintenance of the childhood immunization registry. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Sections 161.007 (Immunization Registry; Reports to Department), 161.008 (Immunization Record), and 161.009 (Penalties for Disclosure of Information), Health and Safety Code. These sections deal with the establishment and maintenance of the childhood immunization registry. SECTION 2. Emergency clause. Effective date: upon passage.
