HBA-TYH H.B. 1505 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1505 By: Yarbrough Urban Affairs 3/15/1999 Introduced BACKGROUND AND PURPOSE Subchapter G, Chapter 143, Local Government Code, establishes civil service requirements for fire fighters and police officers in cities with a population of 1.5 million or more. At this time, the only city affected by Subchapter G is the City of Houston. H.B. 1505 requires cities affected by Subchapter G to establish a classified position of fire marshall and fill it by means of competitive examination procedures contained in Chapter 143 (Municipal Civil Services), Local Government Code. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter G, Chapter 143, Local Government Code, by adding Section 143.1025, as follows: Sec. 143.1025. CLASSIFICATION OF FIRE MARSHAL. (a) Requires the municipality's governing body, in addition to other fire fighter classifications created in accordance with Section 143.021 (Classification; Examination Requirement), to establish the classification of fire marshal by ordinance. (b) Authorizes the classified position of fire marshal to only be filled from an eligibility list that results from an examination held in accordance with this chapter. (c) Provides that the failure of the governing body to establish the fire marshal position by ordinance does not result in the loss of civil service benefits by a person entitled to civil service protection or appointed to the position in substantial compliance with this chapter. SECTION 2. Emergency clause. Effective date: upon passage.
