BACKGROUND AND PURPOSE 

Currently, a person who files for unemployment insurance benefits and meets
the eligibility requirements must wait for a seven-day period before
receiving a payment.  This requirement was put into law with the provision
that employers would get a full chargeback to their account, no matter the
amount of the benefit.  Because the current law states that the amount the
employer is charged is adjusted on a pro-rata basis the original intent is
moot.  H.B. 1595 deletes the requirement for a seven-day waiting period
before receiving unemployment insurance benefits. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 207.021, Labor Code, to delete the requirement
that an unemployed individual is eligible to receive benefits for a benefit
period if the individual has been totally or partially unemployed for a
waiting period of at least seven consecutive days.  Makes conforming and
nonsubstantive changes. 

SECTION 2.Effective date: September 1, 1999.
  Makes application of this Act prospective.

SECTION 3.Emergency clause.
