HBA-NIK H.B. 1596 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1596 By: Deshotel State Recreational Resources 4/4/1999 Introduced BACKGROUND AND PURPOSE Current law allows the Texas Parks and Wildlife Commission to establish a lower fee or to waive the fee or other requirements for a hunting or fishing license for residents or non-residents under the age of 17 or over the age of 65. H.B. 1596 waives the fee for fishing and hunting license requirements for residents under age 17 and over age 65. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 42.012(b), Parks and Wildlife Code, by creating Subsections (1) and (2) from existing text, and making a substantive change. SECTION 2. Amends Section 46.004(b) and (c), Parks and Wildlife Code, as follows: (b) Authorizes the Parks and Wildlife Commission to establish a lower fee or waive the fee or license requirement for a nonresident, rather than a resident or nonresident, who is either under 17 years old or who is 65 years old or over. (c) Requires the commission to waive the fee for residents who are under 17 years old, as well as residents who are 65 years old or older, and creates subsection (3) for existing text. Makes a conforming change. SECTION 3. Emergency clause. Effective date: upon passage.
