HBA-RBT H.B. 1645 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1645 By: Puente Natural Resources 4/20/1999 Introduced BACKGROUND AND PURPOSE Currently, Texas law mandates that all waters subject to interbasin transfers would be junior in priority to all other waters within that originating basin. During times of water shortage, all obligations within the basin would be fulfilled before any waters could be transferred as provided for in an interbasin transfer permit. H.B. 1645 repeals that section of the Water Code. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Section 11.085 (relating to permit procedures, priorities, and procedural aspects to interbasin transfers of water), Water Code. SECTION 2. Makes application of this Act prospective. SECTION 3. Emergency clause. Effective date: upon passage.
