HBA-MPM H.B. 1683 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1683 By: Williams Public Education 4/20/1999 Introduced BACKGROUND AND PURPOSE Current law does not adequately address funding needs for a school district with operational expenses associated with opening a new instructional facility or expanding a new instructional facility. H.B. 1683 entitles a school district to additional allotments for operational expenses associated with opening a new instructional facility (facility) or expanding an existing facility and sets forth these allotments per student in weighted average daily attendance. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority is expressly delegated to the commissioner of education in SECTION 2 (Section 42.158, Education Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter C, Chapter 42, Education Code, by adding Section 42.158, as follows: Sec. 42.158. NEW OR EXPANDED INSTRUCTIONAL FACILITY ALLOTMENT. (a) Entitles a school district (district) to an additional allotment for operational expenses associated with opening a new instructional facility (facility) or expanding an existing facility. (b) Entitles a district to an allotment of $500 per student in weighted average daily attendance (attendance) at the facility for the first school year in which students attend a new instructional facility, and $500 for the second year for each additional student in attendance at the facility. (c) Entitles a district to $250 for each additional student in attendance at an expanded instructional space in an existing facility that is designed to accommodate an increase of at least 10 percent in the number of students in attendance for the first year following the expansion. (d) Sets forth the formulas for determining the number of students and additional students in attendance at an facility. (e) Authorizes the commissioner of education to adopt rules necessary to implement this section. (f) Applies to this section the definition of "instructional facility" assigned by Section 46.001, Education Code, where "instructional facility" means real property, an improvement to real property, or a necessary fixture of an improvement to real property that is used predominantly for teaching the curriculum required under Section 28.002 (Required Curriculum), Education Code. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
