BACKGROUND AND PURPOSE 

Prior to the 76th Legislature, Section 152.0241, Human Resources Code, set
out three separate juvenile boards for Bosque, Comanche, and Hamilton
counties.  These three counties compose the 220th Judicial District and
share a single district judge.  The administration of the juvenile program
is now being conducted jointly; the three counties are represented by their
respective county judges who work in conjunction with the 220th district
judge.  H.B. 1723  modifies the statute to conform with actual practice by
creating a single juvenile board (board) for the three counties, setting
forth the membership of the board, and providing for compensation of the
board members.   

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 152.0241, Human Resources Code, as follows:

Sec. 152.0241.  BOSQUE COUNTY.  (a)  Provides that Bosque County is
included in the Bosque, Comanche, and Hamilton counties juvenile board
(juvenile board).  Establishes that the juvenile board is composed of the
county judge in each of the three counties and the 220th Judicial District
judge.  Makes conforming changes. 

(b)  Provides that the 220th Judicial District judge, rather than the
juvenile court judge, is the chairman of the juvenile board and its chief
administrative officer. 

(c)  Requires, rather than authorizes, the commissioners court of Bosque
County to pay the county judge in Bosque County and the 220th Judicial
District judge, rather than juvenile board members, additional annual
compensation set by the commissioners court at not less than the amount
paid to a board member under this section (Bosque County) on October 1,
1998.  Makes a conforming change. 

(d)  Provides that Section 152.0008(a) (regarding the appointment of
personnel by the chief juvenile probation officer) does not apply to the
juvenile board of Bosque County. Deletes existing text which states that
Sections 152.0003 (Compensation) and 152.0005 (Expenses of Board Members
and Juvenile Court) do not apply to the juvenile board of Bosque County. 

SECTION 2.  Amends Section 152.0531, Human Resources Code, to include
Comanche County in the juvenile board.  Requires, rather than authorizes,
the commissioners court of Comanche County to pay the county judge in
Comanche County and the 220th Judicial District judge, rather than juvenile
board members, additional annual compensation set by the commissioners
court at not less than the amount paid to a board member under this section
(Comanche County) on October 1, 1998 Makes conforming changes. 

SECTION 3.  Amends Section 152.1031, Human Resources Code, to include
Hamilton County in the juvenile board.  Requires, rather than authorizes,
the commissioners court of Hamilton County  to pay the county judge in
Hamilton County and the 220th Judicial District judge, rather than juvenile
board members, additional annual compensation set by the commissioners
court at not less than the amount paid to a board member under this section
(Hamilton County) on October 1, 1998. Makes conforming changes. 

SECTION 4.Emergency clause.
  Effective date: upon passage.
