BACKGROUND AND PURPOSE 

Currently, a student attending a public or private high school within Texas
is granted automatic acceptance to a  general academic teaching institution
provided the student graduated in the top 10 percent of the student's
graduating class within the two years immediately preceding the academic
year for which the applicant is applying.  C.S.H.B. 1804 adds a student who
graduated from a high school operated by the U.S. Department of Defense
under the same conditions to the group of students who are eligible for
automatic admission as provided for in Section 51.803 (Automatic Admission:
All Institutions), Education Code. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 51.803(a), Education Code, to require admittance
to a general academic teaching institution as an undergraduate student if
the applicant graduated from a high school operated by the United States
Department of Defense in the top 10 percent of the student's graduating
class.  Provides that an applicant who graduated from a high school
operated by the United States Department of Defense must be a Texas
resident under Section 54.052 (Residents; Nonresidents; General Rules),
Education Code, or be entitled to pay tuition fees at the rate provided for
Texas residents under Section 54.058(d) (Military Personnel and
Dependents), Education Code, for the term or semester admitted to qualify
for admission under this section.  Makes a nonsubstantive change. 

SECTION 2.  Provides that this Act applies beginning with admissions for
the 2000 fall semester. 

SECTION 3.  Emergency clause.

COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.H.B. 1804 modifies the original in SECTION 1 by clarifying that this
section applies to a student who graduated from a school operated by the
United States Department of Defense only if the student graduated in the
top 10 percent of the student's graduating class.
