BACKGROUND AND PURPOSE 

The 75th Texas Legislature enacted legislation transferring the Texas Water
Well Drillers Advisory Council and the Water Well Drillers and Water Well
Pump Installers Program (program) from the Texas Natural Resource
Conservation Commission to the Texas Department of Licensing and Regulation
(department).  This change in jurisdiction removed the program from
representation on the Texas Groundwater Protection Committee (committee).
H.B. 1848 adds a representative of the program chosen by the director of
the department to the composition of the committee.   

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 26.403(c), Water Code, to add a representative
of the Water Well Drillers and Water Well Pump Installers Program (program)
of the Texas Department of Licensing and Regulation (department) selected
by the executive director of the department to the composition of the Texas
Groundwater Protection Committee (committee). 

SECTION 2.  Requires the executive director of the department, as soon as
possible on or after the effective date of this Act, to appoint to the
committee a representative of the program. 

SECTION 3.Emergency clause.
  Effective date: upon passage.
