BACKGROUND AND PURPOSE 

Currently, counties with a population under 20,000 may jointly construct
and maintain auditoriums with municipalities.  H.B. 1897 removes the
population bracket and changes the definition of what can be jointly built
from "auditoriums" to "recreational and cultural facilities." 


RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 301, Local Government Code, as follows:

New title: CHAPTER 301.  RECREATIONAL AND CULTURAL FACILITIES
JOINTLY ESTABLISHED BY COUNTIES AND MUNICIPALITIES.  Deletes "Auditoriums"
from existing title. 

SECTION 2.  Amends Sections 301.001-301.003 and 301.006-301.008, Local
Government Code, as follows: 

Sec. 301.001.  New title: AUTHORITY TO ESTABLISH RECREATIONAL OR CULTURAL
FACILITIES.  Defines "recreational or cultural facility" as an auditorium,
civic center, convention center, or exposition center.  Authorizes the
commissioners court of a county, rather than a county with a population of
20,000 or less, and the governing body of a municipality in that county,
rather than a county with a population of 10,000 or more, to jointly erect,
acquire, equip, maintain, and operate a recreational or cultural facility
(facility). Makes conforming changes. 

Sec. 301.002.  New title: FINANCING OR RECREATIONAL OR CULTURAL FACILITY.
Makes conforming changes. 

Sec 301.003.  DELEGATION OF AUTHORITY TO BOARD OF MANAGERS; DONATIONS.
Makes conforming changes. 


Sec. 301.006.    AUTHORITY OF BOARD TO CONTRACT.  Makes conforming changes.

Sec. 301.007.  FINANCIAL STATEMENT AND BUDGET.  Makes conforming changes.

(b)  Authorizes the commissioners court of a county and the governing body
of a municipality (governing body), on the basis of the financial statement
and budget, to appropriate to the board of managers (board) an amount of
money that the commissioners court and governing body consider proper and
necessary for the operation of the facility. Makes a conforming change. 

 Sec. 301.008.  PERSONNEL.  Authorizes the board to employ a superintendent
or manager of the facility.  Authorizes the superintendent or manager to
employ permanent or  temporary personnel that are necessary for the
maintenance and operation of the facility.  Makes a conforming change. 

SECTION 3.  Effective date: September 1, 1999.

SECTION 4.  Emergency clause.
