BACKGROUND AND PURPOSE 

Prior to the 76th Legislature, the flag of this state was flown above the
north door of the Capitol, and the flag of the United States was flown over
the south door of the Capitol.  H.B. 1925 requires that the flag of the
State of Texas and flag of the United States be flown above the south door
of the Capitol, and that the flag of the State of Texas alone be flown
above the north door of the Capitol. This bill further regulates the flying
of these flags at half staff over the Capitol and the flying of the POW/MIA
flag over the Capitol.  

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 443, Government Code, by adding Section 443.024,
as follows: 

Sec. 443.024.  DISPLAY OF THE TEXAS AND UNITED STATES FLAG.  (a) Requires
that the flag of the State of Texas and flag of the United States be flown
on the same pole above the south door of the Capitol. 

(b) Requires that the flag of the State of Texas alone be flown above the
north door of the Capitol.  

(c) Requires that the flag of the U.S. alone be flown at half staff above
the south door of the Capitol and the flag of Texas alone be flown above
the north door of the Capitol in the event that the flags are required to
be flown at half staff. 

(d) Requires that the POW/MIA flag and the flag of the U.S., on  the
occasion of the flying of the POW/MIA flag, be flown above the south door
of the Capitol and the flag of the State of Texas alone be flown above the
north door of the Capitol.   

SECTION 2.  Emergency clause.
            Effective date: 90 days after adjournment.
