BACKGROUND AND PURPOSE 

Currently, Texas provides $50,000 to the surviving family of certain public
servants killed in the line of duty.  C.S.H.B. 195 increases the benefits
paid to an eligible surviving spouse to $150,000. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 615.022, Government Code, to require the state to
pay an eligible surviving  spouse of certain public servants $150,000,
rather than $50,000. 

SECTION 2. Effective date: September 1, 1999.
           Makes application of this Act prospective.

SECTION 3. Emergency clause.

COMPARISON OF ORIGINAL TO SUBSTITUTE

The substitute modifies the original bill in SECTION 1 by changing the
amount of the payment to an eligible surviving spouse of certain public
servants from $250,000 to $150,000. 

The substitute modifies the original bill by deleting SECTIONS 2, 3, 4, and
5 of the original bill. SECTION 2 of the original bill amended Section
615.023, Government Code, concerning payments to a surviving minor child.
SECTION 3 of the original bill created Section 615.0235, Government Code,
concerning education benefits for a surviving spouse or minor child.
SECTION 4 of the original bill amended Section 615.024, Government Code, to
require the state to pay an eligible surviving parent $250,000  if there is
only one parent, and $125,000 each if there are two parents. SECTION 5 of
the original bill amended Section 615.025, Government Code, to require the
state to pay an eligible surviving dependent sibling $250,000, divided
equally among all eligible siblings.  

The substitute modifies the original bill by redsignating SECTIONS 6
(effective date) and 7 (emergency clause) in the original bill to SECTIONS
2 and 3.
