HBA-MPA H.B. 1997 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1997 By: Palmer Licensing & Administrative Procedures 4/13/1999 Introduced BACKGROUND AND PURPOSE Currently, the installation, repair, or removal of certain types of vent hoods is covered under the Air Conditioning and Refrigeration Contractor License Law (Article 8861, V.T.C.S.). As the statute is written now, the installation, repair, or removal of a vent hood in any location other than one's home must be completed by a licensed air conditioning and refrigeration contractor. Requiring such a simple procedure to be performed by a licensed air conditioning and refrigeration specialist is unnecessary and costly to consumers. H.B. 1997 removes the simple procedure of installation, repair, or removal of vent hoods from the purview of the Air Conditioning and Refrigeration Contractor License Law. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 6, Article 8861 (Air Conditioning and Refrigeration Contractor License Law (ACRCLL)),V.T.C.S., by adding Subsection (h), to exempt from ACRCLL a person who installs, repairs, or removes a vent hood of the type commonly used in residential and commercial kitchens. SECTION 2. Makes application of this Act prospective. SECTION 3.Emergency clause. Effective date: upon passage.
