HBA-DMD H.B. 2023 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 2023 By: Carter Public Safety 7/30/1999 Enrolled BACKGROUND AND PURPOSE Prior to the 76th Legislature, the Texas Commission on Law Enforcement Officer Standards and Education (TCLEOSE) employed investigators to examine license candidates and complaints against licensees. TCLEOSE investigators, who are not commissioned officers, may be called upon to investigate commissioned officers. H.B. 2023 authorizes TCLEOSE to commission investigators that are employed by TCLEOSE as peace officers for the limited purpose of assisting TCLEOSE in administering this chapter. This bill also makes investigators commissioned by TCLEOSE peace officers. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter A, Chapter 415, Government Code, by adding Section 415.016, as follows: Sec. 415.016. AUTHORITY TO COMMISSION INVESTIGATORS AS PEACE OFFICERS. Authorizes the Commission on Law Enforcement Officer Standards and Education (TCLEOSE) to commission certified peace officers as investigators employed by TCLEOSE for the limited purpose of assisting TCLEOSE in administering this chapter. SECTION 2. Amends Article 2.12, Code of Criminal Procedure, to include investigators commissioned by TCLEOSE under Section 415.016, Government Code, among those that are peace officers. Makes conforming changes. SECTION 3.Emergency clause. Effective date: upon passage.
