HBA-TYH, KMH H.B. 2147 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 2147 By: Flores Urban Affairs 7/22/1999 Enrolled BACKGROUND AND PURPOSE According to the publication "Bordering the Future" produced by the State Comptroller of Public Accounts in July, 1998, Texas does not have adequate affordable housing. The Texas General Land Office is in charge of managing state-owned property. H.B. 2147 requires the Texas General Land Office, through the asset management division, to identify state-owned property that is unused or substantially underused and to furnish an appraisal of these properties to the Texas Department of Housing and Community Affairs. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 31.156, Natural Resources Code, by adding Subsection (e), as follows: (e) Requires the asset management division of the General Land Office to furnish an appraisal to the Texas Department of Housing and Community Affairs (TDHCA) of properties that have been identified as unused or substantially underused. SECTION 2. Amends Section 31.157, Natural Resources Code, by amending Subsection (b), to require the draft report be submitted to TDHCA. Authorized TDHCA to comment on any findings or recommendations made by the Commissioner of the General Land Office and to make additional recommendations regarding the suitability of the property for affordable housing. SECTION 3. Emergency clause. Effective date: upon passage.
