HBA-LCA H.B. 2207 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2207 By: Olivo Transportation 4/18/1999 Introduced BACKGROUND AND PURPOSE In 1997, the 75th Texas Legislature authorized residential subdivisions in a county with a population of 500,000 or more to petition the commissioners court to prohibit a commercial vehicle from parking overnight in a residential subdivision in response to concerns that commercial vehicles might damage residential streets not built to withstand commercial traffic. H.B. 2207 amends Section 545.307, Transportation Code (Overnight Parking of Commercial Motor Vehicle in Residential Subdivision) to provide that residents of a residential subdivision in a county with a population of 300,000 or more may petition the commissioners court to prohibit overnight parking of a commercial vehicle, in response to the same concerns from smaller counties. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 545.307(a)(2), Transportation Code, to provide that "residential subdivision" refers to a subdivision in a county with a population greater than 300,000, rather than 500,000. SECTION 2. Emergency clause. Effective date: upon passage.
