HBA-KMH H.B. 221 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 221 By: Naishtat Judicial Affairs 1/12/1999 Introduced BACKGROUND AND PURPOSE Current state law does not prohibit the appointment of members on the Board of Law Examiners based on the consideration of such characteristics as disability, age, and color. H.B. 221 would prohibit consideration of disability, age, and color as criteria for appointment to the Board of Law Examiners. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 82.001(c), Government Code, by adding color, age, and disability to the list of individual characteristics which cannot be used to distinguish candidates for appointment to the Board of Law Examiners and removes creed from this list. SECTION 2. Makes application of this Act prospective. SECTION 3. Emergency clause. Effective date: upon passage.
