HBA-SEB H.B. 225 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 225 By: Naishtat To Be Determined 1/15/1999 Introduced BACKGROUND AND PURPOSE The 75th Texas Legislature, Regular Session, enacted Section 242.1225, Health and Safety Code (Additional Reporting Requirement), as part of the model nursing home regulation legislation. The information regarding abuse and neglect required by Section 242.1225 is already required to be reported under Section 242.122 (Reporting of Abuse and Neglect). H.B. 225 repeals Section 242.1225, eliminating the duplicate reporting requirement. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Section 242.1225, Health and Safety Code (regarding the additional reporting requirement for convalescent and nursing homes and related institutions). Section 242.1225 currently requires the Texas Board of Human Services to adopt rules that require any person, including the owner or employee of an institution, to report conditions or conduct which result in accidental injury, exploitation, or hospitalization of residents. SECTION 2. Amends Section 242.066(f), Health and Safety Code, to make a conforming change. SECTION 3. Amends Section 242.0665(b), Health and Safety Code, to make a conforming change. SECTION 4. Emergency clause. Effective date: upon passage.
