HBA-NIK H.B. 2303 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 2303 By: Hope State Recreational Resources 8/12/1999 Enrolled BACKGROUND AND PURPOSE Prior to the 76th Legislature, the Parks and Wildlife Code restricted the possession of live game animals, with certain exceptions. If a person was in possession of a game animal and could not produce a license or permit authorizing the person to keep the animal, then that person was in violation of Section 63.002 (Possession of Live Game Animals), Parks and Wildlife Code. However, there was no penalty section for the offense. H.B. 2303 makes it an offense punishable as a Class C Parks and Wildlife Code misdemeanor for a person to be in violation of Section 63.002, Parks and Wildlife Code. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 63.104, Parks and Wildlife Code, by amending Subsection (b) and adding Subsection (c). Provides that a person who violates Section 63.002 (Possession of Live Game Animals) commits an offense that is a Class C Parks and Wildlife Code misdemeanor. Deletes the provision that a person who violates Section 63.007 (Repealed), Parks and Wildlife Code, commits an offense that is a Class B Parks and Wildlife Code misdemeanor. SECTION 2. Effective date: September 1, 1999. SECTION 3. Makes application of this Act prospective. SECTION 4. Emergency clause.
