HBA-NIK H.B. 2303 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2303 By: Hope State Recreational Resources 3/27/1999 Introduced BACKGROUND AND PURPOSE Currently, the Parks and Wildlife Code restricts the possession of live game animals, with certain exceptions. If a person is in possession of a game animal and cannot produce license or permit authorizing the person to keep the animal, then that person is in violation of Section 63.002, Parks and Wildlife Code. However, there is currently no penalty section for the offense. H.B. 2303 makes it an offense punishable as a Class C Parks and Wildlife Code misdemeanor for a person to be in violation of Section 63.002 (Possession of Live Game Animals), Parks and Wildlife Code. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution.
