HBA-LCA H.B. 2314 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2314 By: McReynolds Urban Affairs 3/30/1999 Introduced BACKGROUND AND PURPOSE A civil service director (director) serves as the administrator for a municipal civil service commission (commission). Currently, a director is required to reside within city limits. The commission's function is to hear appeals related to suspension and termination from fire fighters and police officers, relating to suspension and termination on a basis that is rarely more than quarterly, and is not related to emergency situations. There are only 71 municipalities in Texas with civil service directors. H.B. 2314 allows the civil service director of a county with a population of less than 1.5 million to reside outside the city limits. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 143.012(b), Local Government Code, to delete "three years" from language describing a residency requirement for persons under consideration for appointment as director of the civil services commission in certain, specified municipalities. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
