HBA-RBT H.B. 237 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 237 By: Krusee Public Education 2/10/1999 Introduced BACKGROUND AND PURPOSE Currently, a person desiring to file a complaint with the Texas Education Agency is required to give personal information such as name, telephone number and address. If the person wishes to remain anonymous and not submit personal information, the person is informed that the agency has a policy of not accepting anonymous complaints. H.B. 237 requires the agency to accept, record and investigate anonymous complaints, and prohibits the agency from denying a complaint solely because it was filed anonymously. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter B, Chapter 7, Education Code, by adding Section 7.025, as follows: Sec. 7.025. ANONYMOUS COMPLAINTS. Authorizes a person to file an anonymous complaint with the Texas Education Agency and prohibits the agency from refusing to record and investigate the complaint solely because it was filed anonymously. SECTION 2. Emergency clause. Effective date: upon passage.
