HBA-RBT H.B. 2457 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2457 By: Yarbrough Licensing & Administrative Procedures 3/30/1999 Introduced BACKGROUND AND PURPOSE Currently, the Texas Alcoholic Beverage Commission is authorized to promulgate rules setting definite limitations consistent with the general provisions of the Alcoholic Beverage Code, relaxing the restrictions of certain sections of the code. H.B. 2457 authorizes the Texas Alcoholic Beverage Commission to promulgate such rules with respect to Section 102.07 (Prohibited Dealings With Retailer or Consumer). RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority previously delegated to the Texas Alcoholic Beverage Commission is modified in SECTION 1 (Section 108.04, Alcoholic Beverage Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 108.04, Alcoholic Beverage Code, to authorize the Texas Alcoholic Beverage Commission to promulgate rules which set definite limitations consistent with the general provisions of this code, relaxing the restrictions of Section 102.07 (Prohibited Dealings With Retailer or Consumer). SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
