HBA-MPM, ALS H.B. 2538 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 2538 By: Davis, Yvonne Transportation 8/17/1999 Enrolled BACKGROUND AND PURPOSE A motor vehicle must have an annual safety inspection unless it falls under a list of exemptions. The purpose of this bill is to exempt from the requirement a vehicle purchased by an out-of state purchaser to be used exclusively outside the state, in order to allow the purchaser to transport the vehicle out of state. H.B. 2538 exempts from the compulsory vehicle inspection requirement the sale of a motor vehicle that is transported out of state for use exclusively outside the state. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 548.052, Transportation Code, to provide that this chapter (relating to compulsory inspection of certain vehicles) does not apply to a former military vehicle, defined under Section 502.275 (Certain Exhibition Vehicles; Offense), rather than under Section 502.275(o), or to a vehicle qualified for a tax exemption under Section 152.092, Tax Code (Motor Vehicles Transported Out of State). Makes nonsubstantive changes. SECTION 2.Emergency clause. Effective date: upon passage.
