HBA-RBT H.B. 2849 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2849 By: Solis, Jim Natural Resources 3/29/1999 Introduced BACKGROUND AND PURPOSE Currently, the Texas Natural Resource Conservation Commission (TNRCC) has to approve most bond issuances by a water district. The amount of time and expense required to support the review of bond issuance is extensive. H.B. 2849 exempts from this requirement, a water district that is located entirely within a county that borders Mexico and provides the domestic water supply and sewer service for three or more municipalities and to a population in excess of 5,000, according to the most recent decennial census. In application, this bill will exempt the Laguna Madre Water District from the requirement to obtain TNRCC approval prior to issuing bonds. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Title 4, Chapter 49, Subchapter F, Section 49.181(h), Water Code, to provide that this section (Authority of Commission Over Issuance of District Bonds) does not apply to a district that is located entirely within a county that borders Mexico and provides the domestic water supply and sewer service for three or more municipalities and to a population in excess of 5,000 according to the most recent decennial census. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
