BACKGROUND AND PURPOSE 

Current law prohibits a holder of a package store permit from selling more
than five gallons of vinous liquor in a single transaction and a holder of
a wine only package store permit from selling more than five gallons of
ale, wine, and vinous liquors in a single transaction.  Consumers who wish
to purchase more than five gallons of wine, ale, or vinous liquors may find
it inconvenient to have to conduct more than one transaction.  H.B. 2856
repeals these two prohibitions. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Repealers: Sections 22.09 (Limit on Single Transaction) and
24.08 (Limit on Single Transaction), Alcoholic Beverage Code.  Section
22.09 prohibits a holder of a package store permit from selling more than
five gallons of vinous liquor in a single transaction.  Section 24.08
prohibits a holder of a wine only package store permit from selling more
than five gallons of ale, wine, and vinous liquors in a single transaction. 

SECTION 2.  Effective date: September 1, 1999.

SECTION 3.  Emergency clause.
