HBA-ALS H.B. 2880 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2880 By: Chavez Licensing & Administrative Procedures 4/20/1999 Introduced BACKGROUND AND PURPOSE Under current law, a person is prohibited from practicing engineering without a license. However, it is common within the music and film industries for a sound recording professional to use the title of "professional engineer." H.B. 2880 amends the Texas Engineering Practice Act to allow a sound recording professional to use the title "professional engineer" without being licensed under that Act and to provide that such a person using this title is not considered to be engaging in the practice of engineering. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 1.2, Article 3271a, V.T.C.S. (The Texas Engineering Practice Act), to authorize a professional recording engineer to use the title "professional engineer" without being licensed under this Texas Engineering Practice Act and provides that a professional recording engineer is not engaged in the practice of engineering, notwithstanding Subsection (a). Makes nonsubstantive changes. SECTION 2.Emergency clause. Effective date: upon passage.
