HBA-MPA, H.B. 2930 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 2930 By: Walker Urban Affairs 7/13/1999 Enrolled BACKGROUND AND PURPOSE Prior to the 76th Legislature, Section 573.041, Government Code, prohibited a public official from hiring or appointing an individual who will be compensated directly or indirectly with public funds if the individual is related to the public official within the third degree by consanguinity or the second degree by affinity. Public officials in small incorporated municipalities, with populations of 200 or less, had difficulty hiring employees that are not related within those degrees of relationship. H.B. 2930 provides an exception for a municipality that has a population of 200 or less. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 573.061, Government Code, to exempt from the provisions of Section 573.041 (Prohibition Applicable to Public Official) an appointment or employment of a person by a municipality with a population less than 200. Makes nonsubstantive changes. SECTION 2. Makes application of this Act prospective. SECTION 3.Emergency clause. Effective date: upon passage.
