BACKGROUND AND PURPOSE 

The 72nd Legislature created the 42nd Judicial District, in which a
district attorney is elected to prosecute criminal cases in Coleman County.
The legislature did not subsequently repeal the authority of the district
attorney of the 35th Judicial District to prosecute criminal cases in
Coleman County.  C.S.H.B. 2937 repeals Section 43.121(b) (duties of the
district attorney of the 35th Judicial District), Government Code. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Repealer: Section 43.121(b) (duties of the district attorney
for the 35th Judicial District), Government Code.   

SECTION 2.  Effective date: September 1, 1999.

SECTION 3.  Emergency clause.

COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.H.B. 2937 modifies the original in the caption to clarify that the bill
relates to the duties of the district attorney for the 35th Judicial
District. 

C.S.H.B. 2937 modifies the original in SECTION 1 to repeal Subsection (b)
of Section 43.121, Government Code, rather than the entire section. 

C.S.H.B. 2937 modifies the original in SECTION 3 from the long emergency
clause to the short emergency clause.
