HBA-LCA H.B. 3013 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3013 By: Hochberg Public Education 4/19/1999 Introduced BACKGROUND AND PURPOSE Some middle- and high-school students need additional instructional time to master core subjects for their grade level. This becomes difficult to accomplish when a student also must complete requirements in non-core courses. H.B. 3013 permits a student to complete a remedial mathematics course instead of a required enrichment curriculum course if the student fails to perform satisfactorily on the mathematics portion of an assessment instrument adopted under Subchapter B, Chapter 39, Education Code (Assessment of Academic Skills). RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority is expressly delegated to the State Board of Education in SECTION 1 (Section 28.002) of this Act. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 28.002, Education Code, by adding Subsection (l), as follows: (l) Provides that a school district, in accordance with rules adopted by the State Board of Education, may allow a student in middle school, junior high school, or high school to complete a remedial mathematics course instead of a required enrichment curriculum course if the student performs unsatisfactorily on the mathematics portion of an assessment instrument adopted under Subchapter B, Chapter 39, Education Code (Assessment of Academic Skills). SECTION 2. Provides that this Act applies with the beginning of the 1999-2000 school year. SECTION 3. Emergency clause. Effective date: upon passage.
