HBA-ATS H.B. 3060 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3060 By: Hill Transportation 4/4/1999 Introduced BACKGROUND AND PURPOSE The Transportation Code requires an owner or lessee of a commercial motor vehicle whose title is registered in another state to obtain a certificate of title for registration purposes only. This certificate is needed by an owner or lessee of a vehicle that is registered or titled in another state and subject to registration in Texas who chooses not to surrender the out-of-state title. Such an owner or lessee must apply for this certificate and pay all required fees at a county tax assessor-collector's office. However, to obtain apportioned licensed plates, the owner must register with the Texas Department of Transportation. It can be inconvenient and costly for commercial vehicle operators to go to two different locations to receive an apportioned license plate. H.B. 3060 requires the owner or lessee of a commercial vehicle operating under the International Registration Plan or other agreement under Section 502.054 (Agreements With Other Jurisdictions; Offense), Transportation Code, who is applying for a certificate of title for registration purposes only, to apply directly to the Texas Department of Transportation. Under this bill, the department is required to collect all fees required under Section 501.138 (Collection and Disposition of Fees), Transportation Code, and to distribute them in accordance with the provisions of Section 501.138. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 501.023, Transportation Code, by adding Subsection (c), as follows: (c) Requires the owner or lessee of a commercial vehicle operating under the International Registration Plan or other agreement under Section 502.054 (Agreements With Other Jurisdictions; Offense) who is applying for a certificate of title for registration purposes only to apply directly to the Texas Department of Transportation (department). Requires the department to collect all fees required under Section 501.138 (Collection and Disposition of Fees) and distribute them in accordance with the provisions of Section 501.138. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
