HBA-KMH H.B. 3066 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3066 By: Hinojosa Criminal Jurisprudence 3/29/1999 Introduced BACKGROUND AND PURPOSE H.B. 3066 prohibits the court from requiring an attorney representing the state, without the written consent of the attorney, to participate in mediation, dispute resolution, arbitration, or similar procedure, with respect to a criminal offense. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 26.13, Code of Criminal Procedure, by adding Subsection (h), as follows: (h) Prohibits the court from requiring an attorney representing the state, without the written consent of the attorney and notwithstanding Subsection (g), to participate in mediation, dispute resolution, arbitration, or a similar procedure. SECTION 2. Emergency clause. Effective date: upon passage.
