HBA-KMH H.B. 3322 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3322 By: Chavez Human Services 3/30/1999 Introduced BACKGROUND AND PURPOSE The Texas Department of Human Services (DHS) provides information to providers and clients regarding day care for adults. Concerns have been raised that adult day care is not being adequately explained and offered as an option by DHS personnel. Some Texans who qualify for adult day care may not be receiving information necessary to pursue this option. H.B. 3322 requires DHS to train personnel whose job it is to provide this information to the public and requires DHS to require those employees to provide proof that they have provided this information to the public. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority is expressly delegated to the Texas Department of Human Services in SECTION 1 (Section 103.012, Human Resources Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 103, Human Resources Code, by adding Section 103.012, as follows: Sec. 103.012. EXPLANATION OF AVAILABLE SERVICES. Requires the Texas Department of Human Services (DHS), by rule, to develop and implement a program to train DHS employees whose employment responsibilities include explaining services provided by an adult day care facility or an adult day health care facility to effectively explain those services to an applicant or an applicant's guardian. Requires DHS to require the DHS employee to provide proof that the services were explained to an applicant or the applicant's guardian. Provides that the proof must be in a manner determined by DHS. SECTION 2. Requires DHS to develop and implement the training program required by Section 103.012, Human Resources Code, as added by this Act, not later than January 1, 2000. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
