HBA-JRA H.B. 3353 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3353 By: Ritter Public Education 4/20/1999 Introduced BACKGROUND AND PURPOSE Currently a school district employee who is injured by a student in the special education program in not entitled to assault leave. H.B. 3353 entitles a school district employee who, during the performance of the employee's regular duties, is injured by a student enrolled in a special education program to assault leave for the number of days of leave necessary to recuperate from all physical injuries sustained as a result of the assault. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 22.003, Education Code, by adding Subsection (c), as follows: (c) Entitles a school district employee who, during the performance of the employee's regular duties, is injured by a student who qualifies for services under Subchapter A (Special Education Program), Chapter 29 (Educational Programs), to assault leave for the number of days of leave necessary to recuperate from all physical injuries sustained as a result of the assault. SECTION 2. Makes application of this Act prospective to the 1999-2000 school year. SECTION 3.Emergency clause. Effective date: upon passage.
